1. Welcome

Welcome to the solfest.org.uk Web Site (the “Site”). Solfest is a company registered in England No - 5407557 and trading as Solfest Ltd. We provide this Site as a service to its customers. Please review the following basic rules that govern your use of our Site (the “Agreement”). Please note that your use of our Site constitutes your agreement to follow and be bound by these terms. If you do not agree to these terms, please do not use this Site.

Although you may “bookmark” a particular portion of this Site and thereby bypass this Agreement, your use of this Site still binds you to the terms. Solfest reserves the right to update or modify these Terms and Conditions at any time without prior notice. Your use of the Site following any such changes constitutes your agreement to follow and be bound by the Terms and Conditions as changed. For this reason, we encourage you to review these Terms and Conditions whenever you use this web site.

2. Usage Restrictions; Intellectual Property

All of the content you see and hear on the Solfest Site, including, for example, all of the page headers, images, illustrations, graphics, audio clips, video clips, and text are subject to trademark, service mark, trade dress, copyright and/or other intellectual property rights or licenses held by Solfest, one of its affiliates or by third parties who have licensed their materials to Solfest. The entire content of Solfest Site is copyrighted as a collective work under applicable copyright laws, and coordination, arrangement and enhancement of the content.

The content of the solfest.org.uk web site, and the site as a whole, are intended solely for the personal, not-for-profit use by the users of our site. You may download, print or store selected portions of the content, provided you (1) only use these materials for your own personal, not-for-profit use, (2) do not copy or post the content on any network computer or broadcast the content in any media, and (3) do not modify or alter the content in any way, or delete or change any copyright or trademark notice. Thus, Solfest will own exclusively all such rights, titles and interests and shall not be limited in any way in its use, commercial or otherwise, of any Comments. Solfest is and shall be under no obligation (1) to maintain any Comments in confidence; (2) to pay to user any compensation for any Comments; or (3) to respond to any user Comments.

You agree that no Comments submitted by you to the Site will violate any right of any third party, including copyright, trademark, privacy or other personal or proprietary rights(s). You further agree that no Comments submitted by you to the Site will be or contain libellous or otherwise unlawful, abusive or obscene material. You are and shall remain solely responsible for the content of any comments you make.

5. Correction of Errors and Inaccuracies

The information of the solfest.org.uk web site may contain typographical errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change and update information at any time without prior notice (including after you have submitted your order). Please note that such errors, inaccuracies or omissions may relate to product description, pricing and availability. We apologise for any inconvenience this may cause you. If you are not fully satisfied with your solfest.org.uk merchandise purchase you may return it with the original solfest.org.uk order receipt email. Please see our Returns Policy.

6. Typographical Errors

In the event a solfest.org.uk product is listed at an incorrect price due to typographical error or systems error, solfest.org.uk shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. solfest.org.uk shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, solfest.org.uk shall issue a payment to your credit card account in the amount of the incorrect price.

7. Term; Termination

These terms and conditions are applicable to you upon your accessing the site/ or completing the shopping process. These terms and conditions, or any of them, may be terminated by solfest.org.uk without notice at any time for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

8. Notice

solfest.org.uk may deliver notice to you by means of electronic mail, a general notice on the site, or by written communication delivered by first class mail to your address on record in solfest.org.uk order information.

9. Enforcement of Terms and Conditions

By accessing and using the solfest.org.uk web site, you agree that your access to and use of the solfest.org.uk web site is subject to these Terms and Conditions, as well as all applicable laws, as governed by and construed in accordance with English Law. The parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.

Harassment in any manner or form of the site, including via e-mail and chat or by obscene or abusive language is strictly forbidden. Impersonation of others, including a Solfest or other employee, host, or representative as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through this site any content which is libellous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offence, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or organisation.

11. Indemnification

You agree to indemnify, defend, and hold harmless Solfest, its officers, directors, employees, agents, licensors and suppliers (collectively the “Service Providers”) from and against all losses, expenses, damages and costs, including reasonable attorney’s fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

12. Third Party Links

In an attempt to provide increased value to our visitors, solfest.org.uk may choose various third-party web sites to link to from its own site. However, even if the third party is affiliated with Solfest, Solfest has no control over these linked sites, all of which have separate privacy and data collection practices, independent of Solfest. Solfest has no responsibility or liability for these independent policies or actions and is not responsible for the privacy practices or the content of such web sites. These linked sites are only for your convenience and therefore you access them at your own risk. None the less, Solfest seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its site, but for sites it links to as well (including if a specific link does not work).

TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, SOLFEST DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. SOLFEST DOES NOT REPRESENT OR WARRANT THAT THE FUNCTIONS CONTAINED IN THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT THE DEFECTS WILL BE CORRECTED, OR THAT THIS SITE OR THE SERVER THAT MAKES THE SITE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. 15. Limitation of Liability

SOLFEST SHALL NOT BE LIABLE FOR ANY SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE MATERIALS ON THIS SITE OR THE PERFORMANCE OF THE PRODUCTS, EVEN IF SOLFEST HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

16. Your Right to Cancel

Under the United Kingdom’s Distance Selling Regulations, you have the right to cancel the contract for the purchase of items within a period of 7 working days, beginning with the day after the day on which the item is delivered. This applies to all of our products but not to ticket sales which are non-refundable.

Tickets

Online Packaging and Postage

Getting your tickets online is the easiest way for you to buy, however it costs us significantly more than walk up sales.

This is why, for online orders only, we have had to introduce a minimum postage and packing charge of £2 to help cover the extra costs which we have to pay. This charge is not a booking fee.

We do not charge you separately for things like:

  • PayPal Fees 
  • Credit/Debit Card Fees 
  • Ticket Processing
  • The cost of running our online shop or for employing a ticket agent 

These kinds of booking fees are included in the ticket price, see below for more details.

We do our very best to keep costs down and never make a profit on them at your expense.

Booking Fees

We don't charge you a separate booking fee for buying your Solfest tickets, however that does not mean that we are not charged a fee by our ticketing agents.

As a gesture of good will to you, Solfest will cover this cost at the point of sale.

In the unlikely event that we are forced to cancel the festival, the booking fee for each ticket will be deducted by the agent before any refund is made to you.

Delivery

We receive a large amount of ticket orders every day and batch process them - as a result you will not receive your tickets through the post immediately. This applies to both Standard and Special Delivery orders. If you have not received your tickets by mid-August please get in touch.

Tickets ordered closer to the festival may be held at the gate for you to collect. You will be advised at the time of ordering if this applies to your order. If you do not hear anything to the contrary they will arrive through the post.

If you have query about tickets ordered on the website our online form is the best way to get in touch (select Ticket Sales as your reason for enquiry) and remember to include your order reference number.

Refunds and Transfers

Tickets are non-refundable, unless the event has been officially cancelled, please see above for more details.

You may however, give or sell your ticket to another person, provided you don't charge more for it than you paid.

Postage and packing charges are also non-refundable.

Buying our tickets, with the sole intention of selling them on (touting) is not allowed.

Lost or Stolen Tickets

We are unable to replace or refund tickets which have been lost or stolen. If you are concerned about this, please consider taking out suitable holiday/travel insurance or contact your card company to see if they cover your purchases.

For peace of mind select the 'Recorded' or 'Special Delivery' option during checkout. Both cost a little more but offer proof of posting and online tracking. Special Delivery also includes insurance up to £2,500. A signature will be required for delivery.

Merchandise and Products

Returns and Refunds

At Solfest we want you to be delighted every time you shop with us. Occasionally though, we know you may want to return items. If you are not satisfied with your purchase, you have 7 days from the date of delivery to return your order to us for a refund.

We reserve the right to refuse to refund items that are not returned within 7 days of delivery.

Where applicable, items returned must be in a re-saleable condition i.e. undamaged, in their original and undamaged packaging, unworn and complete with all tags and labels attached.

We reserve the right to refuse to refund items that are returned that are not in re-saleable condition. Goods returned in an unsatisfactory and not in a re-saleable condition may be returned to you at your expense.

Delivery charges are non-refundable.

Please notify onlne sales support that you are returning your order, pack the relevant item securely and send it to us with a copy of the sales reciept so that we receive it within 7 working days after the day of the date that the item was delivered to you.

Send the parcel using any secure and traceable method i.e. Recorded/Special delivery, and retain your proof of postage receipt. Please be sure your package is insured and prepaid.

Please note returns can take up to 28 days to be processed.

Your refund will be credited back via the original method of payment. Please allow up to 3-5 days for your refund to appear on your bank statement.

PayPal Payments

PayPal orders will be treated as any other order, your PayPal account will be deducted when we receive your order. Any returns can be sent to us by post. In both cases your PayPal account will be credited, cash and card refunds are not available on PayPal orders.
